Why do we use your personal data?

We will use your personal data to the succeeding purposes:

To manage your purchase, by processing your orders and send you notifications of delivery status or in the event of any problems with the delivery of your items.

We will use your personal data to manage your payments.

Your personal data is being used to identify you.

We will use your personal data to manage your queries, to handle complaints and warranty matters for products and technical support matters through e-mail, the chat function on simplero, telephone and through social media.

We may also contact you if there is a problem with your order.

We will use your personal data to send you marketing offers, information about products, campaigns and personal offers. 

We will process your data when you enter our competitions. Your personal data will be used for Sustaina Company to contact contestants regarding the competition, before and after an event, to identity contestants, to contact winners, deliver and follow up on prize deliveries.

We will use data to evaluate, develop and improve our services, products and systems for all of our customers. For this purpose, we will not analyze your data on an individual level, all processing will be done on pseudonymized data.

We will use your personal data to comply with obligations in laws, court rulings and decisions from authorities.

 

The legal ground for processing of your personal data?

For every specific process of personal data we collect from you, we will inform you whether the provision of personal data is statutory or required to enter a contract and whether it is an obligation to provide the personal data and possible consequences if you choose not to.

The processing of your personal data is necessary for Sustaina Company to fulfil the service of managing and delivering the order to you.

The processing of your personal data is based on your consent when you agree to direct marketing. The consent is giving in connection with an order or participation in a competition.

The processing of your personal data, is necessary so we can send pertinent product information, based on legal requirements.

All personal data will be processed in agreement with the rules in chapter 3 in the Danish Data Protection Act (databeskyttelsesloven).

Where do we store your data?

The data that we collect from you is stored within the EU, but may also be transferred to and processed in a country outside of the EU. Any such transfer of your personal data will be carried out in compliance with applicable laws.

For transfers outside the EU, Sustaina Company will use Standard Contractual Clauses and Shields as safeguards for countries without adequacy decisions from the European Commission.

Your personal data that is forwarded to third parties are only used to provide you with the services mentioned above, communication agencies to send you your order confirmation, connection with the delivery of your order and payment service providers for your payment. To optimize the website and analysis tools to help optimization.

We never pass on, sell or swap your data for marketing purposes to third parties outside our company.

We pass along our personal information to the following companies:

All companies that we transfer information to, are data processor and we are still the data controller.

 

Transfer to recipient of personal data in third counties

Some personal information will be transfered to recipient outside the EU and EØS.

This is mostly Simplero and Google analytics, wich are both located in the USA.

The United States of America is on the commissions list of secure countries to collaborate with. Because of the protection level.

 

Where do our personal data come from?

All personal data that we are processing, device from information based on the customers consent or pseudonymized data.

 

How long do we save your data?

How long we will keep your data, depend on what kind of information it is. We will always try to minimize our processing of data, therefore we will limit the time a data in our processing. All information will be deleted when you withdraw your consent or when you are no longer a customer.

 

Automated decision making, including profiling

We use automated decision making, including profiling to the use of analyzing our customers. When we are using profiling, we are getting an overview of the types of clients. We use Google Analytics to our profiling, because all information therefore is pseudonymized.

 

Your right to withdraw your consent:

You have the right to withdraw your consent for the processing of your personal data at any time and also object to direct marketing. If you want to do so, contact us as described in the beginning.

When you do so, Sustaina Company won't be able to send you any further direct marketing offers, or information based on your consent. This do not affect the legality of the processing of data before the withdraw of the consent. The withdraw of your consent is therefore first authorized when we recieve the withdrawal.

 

What are your rights:

On the basis of the data protection regulation, you have some rights when we are processing your personal data.

If you want to use your rights, you need to contact us.

 

Right to access:

You have the right to request information about the personal data we hold on you at any time. Please contact us and we will provide you with your personal data by e-mail.

 

Right to rectification: 

You have the right to request rectification of your personal data if the information is incorrect, including the right to have incomplete personal data corrected.

 

Right to erasure:

You have the right to in some cases to erase any personal data processed by Sustaina Company at any time. This can happen before our normal erase rules occur. There are some situation where this is not possible:

*You have an ongoing matter with Customer Service

* You have an unsettled debt with Sustaina Company, regardless of the payment method

* if you have made a purchase, we will keep the personal data linked to your transaction for bookkeeping purposes.

 

Your right to object to processing based on legitimate interest:

You have the right to object to processing of your personal data that is based on Sustaina Company legitimate interest. Sustaina Company will not continue to process the personal data unless we can demonstrate legitimate grounds for the process which overrides your interest and rights or due to legal claims. Then we can only process your information with your consent or by legal claims or in the interest of the society.

 

Your right to demurrer

You have the right to object to the processing of your personal data. This can be objection to processing your personal data to direct marketing.

 

Your right to transmit data (dataportabilitet)

You have the right to get your personal data, in a structure, commonly used and machine-readable format, and transferred to another data controller.
